Attorney McClelland is an incompetent liar!

McClelland was appointed to represent me at a restitution hearing. At no time was I able to contact McClelland as he accepted no collect calls, refused certifed letters, and was a no show at the only meeting that he had scheduled to meet with me. On 8-13-2009 he urged me to waive my right to appear at the restitution hearing with the promise that he would subpoena the documents that he needed in order to prove my innocence. That never happened. Then he told me that there was illegal influence in my prosecution and advised me to file a writ of habeas corpus. I filed the petition for writ of habeas corpus on 10-9-2009 in San Diego.
Prior to the 9-23-2009 hearing I was informed by the OAC that the hearing was going to be postponed so that I could file my writ challenging my unlawful conviction. I was told by the OAC (McClelland accepted no calls from me) that the 9-23-2009 hearing was going to be postponed and that I did not have to worry about it. The fact is the hearing was not postponed and then McClelland lied in a subsequent letter stating that he was unable to have get the court to postpone it when the fact is HE NEVER EVEN ASKED. McClelland showed up at the hearing totally unprepared with not even one piece of paper in my defense. Then he filed a notice of appeal without ever speaking to me. All the details of this matter are pending in my writ of habeas corpus at the US District Court 11cv758MDD. I will also be filing an action against McClelland before 9-23-2012 for fraud, misrepresentation, legal malpractice, and ineffective assistance of counsel. His incompetence has cost me hundreds of thousands of dollars. He is a lying cheat and should not be allowed to practice law.
